These Terms & Conditions are provided in accordance with the Australian Consumer Law (ACL), the Fair Trading Act 1987 (NSW), and other applicable legislation. They explain how our services operate and the conditions under which they are provided.
By enrolling, attending classes, or entering our premises, you acknowledge and agree to these Terms & Conditions.
1. SERVICE DESCRIPTION

Xtreme B-Force Martial Arts provides structured martial arts training programs delivered over a 12-month membership term, unless otherwise agreed in writing.
Training is delivered as part of a year-round program, not on a per-class basis.

2. FEES & PAYMENT OBLIGATIONS
​

Membership fees are payable regardless of attendance
-
Fees are calculated on an annual program basis
-
Payments remain payable during public holidays, school holidays, illness, injury, personal circumstances, timetable changes, or academy closure periods (including the December shutdown)
-
Class schedules may be modified due to operational requirements, enrolment numbers, staff availability, or holidays

Timetable changes do not entitle members to refunds, credits, suspensions, or fee reductions, except where required by law.

3. CANCELLATION & TERMINATION
Fixed-Term Commitment
Memberships operate on a fixed 12-month term.
If cancellation is requested before the end of the term:

An Early Termination Fee (ETF) applies, calculated as a genuine pre-estimate of loss, consistent with ACL requirements
-
The ETF is payable immediately
​
Renewal & Notice
​
-
Memberships automatically renew into a new 12-month term unless cancelled in writing before renewal
-
After renewal begins, 4 weeks’ written notice is required
-
Fees remain payable during the notice period
​
Written Notice
​
Cancellations must be submitted in writing via the official cancellation form or email.
Verbal, SMS, social media, or third-party cancellations are not accepted.
​
4. NO REFUNDS POLICY (ACL-COMPLIANT)
Payments are non-refundable, including for:

Change of mind
-
Non-attendance
-
Illness or injury
-
Timetable or instructor changes
-
Relocation or holidays
​
Refunds will only be provided where required under Australian Consumer Law, including where a major failure of service occurs.
​
5. PARTICIPATION, SAFETY & MEDICAL RESPONSIBILITY
Martial arts is a physically demanding activity involving inherent risks.
By enrolling, participants (or parents/guardians) confirm that:

They are medically fit to participate

All relevant medical conditions have been disclosed

No professional or medical restriction prevents participation
​
Xtreme B-Force Martial Arts reserves the right to limit, modify, or refuse participation where it is reasonably necessary to protect the safety of the participant or others.

6. RISK ACKNOWLEDGEMENT
Participants acknowledge that:

Martial arts training involves inherent physical risks
-
Injuries may occur despite reasonable care and supervision
​
Participation occurs at the participant’s own risk, subject to the Provider’s obligation to exercise due care and skill under Australian law.
​
7. CONDUCT & RIGHT TO REFUSE SERVICE
We maintain a safe and respectful training environment.
​
Xtreme B-Force Martial Arts may suspend or terminate participation for:
​

Unsafe or disruptive behaviour
-
Aggressive or inappropriate conduct
-
Failure to follow instructor directions or academy rules
​
This right is exercised lawfully and reasonably to protect safety and operations.
​
8. PARENTS & GUARDIANS
Where the participant is under 18:
​

A parent or guardian is financially responsible
-
Parents agree to ensure compliance with all academy rules and safety requirements
​
9. PHOTOGRAPHY, VIDEO & INTELLECTUAL PROPERTY
​

Video recording is prohibited unless authorised in writing
-
Photography is for personal use only
-
Training methods, curriculum, and techniques remain the intellectual property of Xtreme B-Force Martial Arts
​
10. PRIVACY & CCTV
CCTV operates on the premises for safety and security purposes.
Footage is:
​

Stored securely
-
Used only for lawful purposes
-
Managed in accordance with the Privacy Act 1988 (Cth)
​
11. DISPUTE RESOLUTION
If a dispute arises:
​
-
It must first be submitted in writing
-
Xtreme B-Force Martial Arts will be given a reasonable opportunity to respond
​
This clause does not remove the right to pursue external remedies under NSW law or ACL.
​
12. CONTINUATION OF TERMS
These Terms & Conditions:

Apply to the initial term and all renewal terms
-
Continue unless lawfully amended
-
Do not override rights guaranteed by Australian Consumer Law
​
AUSTRALIAN CONSUMER LAW STATEMENT
​
Nothing in these Terms & Conditions is intended to exclude, restrict, or modify any consumer rights or remedies available under the Australian Consumer Law or NSW legislation.
​
Services are provided with due care and skill. Where a service is not supplied as required under law, appropriate remedies will be available in accordance with ACL.
